1. About Concrete Forms
Concrete Forms is a trading brand of Height Barriers Ltd, a company registered in England and Wales under company number 14309958. Our business address is Unit 5 Vastre Industrial Estate, Heol Vastre, Newtown, Powys, SY16 1DZ. You can contact us at info@concreteforms.co.uk or on 01686 213370.
These terms apply to purchases made through this website, by telephone, by email or through a written quotation. If you are a consumer, nothing in these terms limits the statutory rights that cannot legally be excluded. If you are ordering for a business, trade or profession, the business provisions below also apply.
2. Product information and specifications
- We take reasonable care to describe our manufactured road forms, steel plates and site equipment accurately.
- Dimensions, weights, capacities, colours and finishes are approximate unless a written quotation or drawing states that a measurement is guaranteed.
- Photographs and renders are illustrative. Screen settings, raw-steel variation and manufacturing tolerances can affect appearance.
- We may make minor design or manufacturing changes that do not materially reduce a product’s function or quality.
- You are responsible for checking that the selected product, dimensions, finish and options are suitable before ordering.
Load-bearing products, including road plates, must be selected, installed and used under a competent person’s direction. Safe capacity depends on factors including span, support, loading, restraint, ground conditions and site environment; thickness alone does not establish safe capacity.
3. Quotations, orders and contract formation
A website listing, estimate or quotation is an invitation to place an order and is not an acceptance. Your order is an offer to buy. A binding contract is formed when we send written acceptance, accept payment or begin manufacture, whichever occurs first.
Please check your confirmation promptly and tell us about any mistake. We may decline or cancel an order before acceptance if a product is unavailable, delivery is impractical, information is incomplete, fraud is suspected or a price or description contains an obvious error. Any payment taken for an order we cannot accept will be refunded.
4. Prices and payment
- Unless stated otherwise, website product prices include VAT at the standard 20% rate and exclude delivery. Delivery and any additional charges are shown or confirmed before the order is accepted.
- Payment must be made using a method offered at checkout or agreed in writing.
- Unless credit terms are agreed in writing, cleared payment may be required before manufacture or dispatch.
- Goods remain the property of Height Barriers Ltd until paid for in full.
5. Manufactured and bespoke products
Many products are manufactured by us after an order is accepted. Bespoke products include items made to customer drawings, non-standard dimensions, personalised finishes, special hole patterns or other customer-specific requirements. You must approve drawings or specifications when requested. We are not responsible for an error in information or dimensions supplied or approved by you.
Manufacturing lead times start after we have all required information, approval and payment. Changes requested after manufacture has started may affect price and delivery and may not be possible.
6. Delivery, access and collection
- Lead times and delivery dates are estimates unless we expressly agree a guaranteed date in writing.
- Please do not book labour, plant or concrete pours until the goods have arrived and been checked.
- You must provide an accurate delivery address, contact number and details of restrictions, vehicle access and unloading facilities.
- Large or heavy products may require suitable mechanical unloading arranged by the customer unless our quotation says otherwise.
- Additional costs caused by failed delivery, unsuitable access, delay at site or redirection may be charged.
For consumers, we will deliver within the time agreed or, if no time is agreed, within the period required by law. For business customers, risk passes on delivery or collection. For consumers, risk passes when you or a person identified by you takes physical possession of the goods.
7. Cancellation and returns
Consumers buying at a distance
If you are a consumer ordering online, by telephone or by email, you will normally have 14 days after receiving standard goods to tell us that you wish to cancel. You then have a further 14 days to return them. To cancel, email info@concreteforms.co.uk with your name, order number and clear cancellation request.
You are normally responsible for return costs unless the goods are faulty or not as described. Goods should be kept safe and returned with all components. We may reduce a refund if handling beyond what is reasonably necessary has reduced their value. Where the statutory right applies, we will refund the price and the least expensive standard outbound delivery option within 14 days after receiving the goods back or receiving satisfactory evidence of return.
The change-of-mind cancellation right does not normally apply to genuinely bespoke or personalised goods made to your specification. This exception does not affect your rights if goods are faulty, not as described or otherwise fail to meet legal requirements.
Business and other cancellations
Business orders and orders outside a statutory consumer cancellation right may be cancelled only with our written agreement. Because material and manufacturing costs can be committed quickly, we may charge a reasonable cancellation fee of up to 45% of the order value, based on costs and work already committed. Bespoke products cannot normally be cancelled once manufacture has begun. Any treatment of a deposit will reflect the work, materials and other costs already incurred.
8. Damaged, faulty or incorrect goods
Check goods as soon as reasonably possible. Record visible transport damage on the delivery paperwork and send photographs and order details to us promptly. Business customers should report shortages, visible damage or incorrect items in writing within seven working days. A short reporting period helps us investigate carrier damage but does not remove rights that cannot legally be limited.
If goods are faulty, damaged before risk passes, not as described or incorrectly supplied, contact us before returning them. After inspection, we will provide the repair, replacement, price reduction or refund required by the contract and applicable law. As the manufacturer, we handle valid product issues directly.
9. Installation, use and maintenance
Products must be transported, lifted, installed, inspected, used and maintained by competent people using a suitable risk assessment and method statement. Follow supplied instructions and applicable law, standards and site rules. Do not use damaged, modified or unsuitable equipment. We are not responsible for loss caused by misuse, poor installation, overloading, inadequate support, unauthorised alteration or failure to maintain the product.
10. Website and intellectual property
The website, product copy, drawings, photographs, graphics and other content are owned by or licensed to Height Barriers Ltd. You may view and print content for your own purchasing and internal business use. You must not reproduce, republish, sell or commercially exploit it without written permission.
11. Liability
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where liability cannot be excluded, or any other liability that law does not allow us to exclude.
For business customers, to the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, contracts, anticipated savings, goodwill or production. Our total liability arising from an order will not exceed the amount paid for the relevant goods, except where that limitation is prohibited by law. Consumers retain all mandatory statutory remedies.
12. Events beyond reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, including material shortages, transport disruption, severe weather, industrial action, utility failure, fire, flood, epidemic, government action or failure of a supplier. We will take reasonable steps to reduce the effect and keep you informed.
13. Privacy
We use personal information as explained in our Privacy Policy. Website and account security information is available in our Security Policy.
14. General terms and governing law
If any provision is found invalid or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver. No other person has a right to enforce this contract unless the law says otherwise.
These terms and each contract are governed by the law of England and Wales. Business customers agree that the courts of England and Wales have exclusive jurisdiction. Consumers may also have the right to bring proceedings in the part of the UK where they live.
